ROCKET VIDEO MEMBERSHIP APPLICATION AND RENTAL AGREEMENT CONDITIONS AND TERMS

 

 

  1. RENTAL FEE:  Rental fees begin on the day that the rental item is rented.  If returned at any time that day or before closing two days later, one day’s rental fee will be due.  One day’s rental fee will be charged for every day past due.  The store will not charge a fee for those days that it is closed.
  2. LOST, STOLEN, DAMAGED, OR DESTROYED ITEMNS:  VHS tapes, laser discs, DVDs or any rental item must be returned in the same condition as when they were picked up, except for normal wear and tear.  Cassettes must be returned fully rewound.  If a rental item has been tampered with beyond repairing or lost, the customer will be responsible for the full payment of the item plus 14 days late charges.  Any item not returned after 30 days is considered lost.  A $250.00 fee will be charged for any item that is unavailable and irreplaceable.
  3. TITLE:  The store retains title to all video cassettes, laser discs, DVDs, audio cassettes and CD ROMs.
  4. BROADCAST OR DUPLICATION: No rental items may be copied, duplicated, altered, reproduced, transmitted or broadcast in any form or by any means whatsoever other than for the use in which it was originally intended.  Rental items are for home playing/viewing exclusively.
  5. GUARANTEE: If the rental item malfunctions for any reason, the customer must return it to ROCKET VIDEO with the claim of the defect.  If the customer returns the defective item before the time it is due, the customer will not be obligated for the rental fee.  There are no other warranties, express or implied, as to the merchantability or fitness of any particular purpose of the item.  The customer will not be entitled to and hereby waives the right to any general, special or consequential damages due to the use of the store’s rental items.
  6. OUTSTANDING BALANCES:  Late fees not paid within 10 days of return of the rental item shall be charged to the customer’s credit card for payment.  Account balances will be charged on the 1st and 15th of each month.  Customers authorize and agree to let Rocket Video charge these balances.
  7. SALES POLICY:  If any item sold is found to be defective, it may be exchanged for the same item or an item of equal value if returned within 7 (seven) days of purchase.  No adjustments will be made without a sales slip.  No cash refunds or charge backs will be allowed.
  8. COLLECTIONS:  In the event it is necessity to initiate collection of sums due, the customer shall, in addition to any amounts due, pay interest at the maximum rate allowed by law and reasonable attorney fees.
  9. EXTRA PERSONS ON ACCOUNT:  The customer opening the account is responsible for any fees or balances accrued by persons they have allowed to rent on their account
